1. Scope of these terms
These terms apply when Powered By More supplies website design, development, ecommerce setup, digital product, application, automation or authorised website security and resilience review services. They should be read with the written proposal, scope or order confirmation for the project. If there is a conflict, the written scope takes priority for project specific matters.
The website describes services and indicative packages. It is not, by itself, an offer capable of acceptance. A contract is formed only when we issue or approve a written scope and you accept it, or when we accept payment for that agreed scope.
The free website check offers a link to Google's technical diagnostic and an email route to request a human homepage review. Technical results appear on Google's website. Human reviews are handled separately after you send your request. These findings and suggestions are informational only and are not a complete technical, accessibility, SEO, legal, security or commercial audit. Results can change between tests and do not guarantee rankings, compliance, security, traffic or sales.
2. Ordering and payment
- You send an enquiry and sufficient information for us to assess the work.
- We confirm the deliverables, exclusions, price, timetable and responsibilities in writing.
- You check the scope and tell us about any error before payment.
- You pay through the Powered By More Stripe checkout or another agreed method.
- We confirm acceptance and the project start requirements.
If a payment is made for work we have not agreed to undertake, we may reject the order and return the payment.
The £395 fixed package prices displayed on this website are the total price payable for the stated scope. No additional VAT is added to those checkout prices. Third party costs, hosting, domains, licences, photography, extensive copywriting and work outside scope are excluded unless expressly included.
3. Project information and client responsibilities
You must provide accurate instructions, approved content and assets, lawful access to relevant systems, and one authorised decision maker. You warrant that you have the right to provide and authorise our use of all material and access supplied to us.
For any security or resilience review, you must own the system or have express authority from its owner. Our work is limited to the written scope. We will not conduct intrusive testing, exploitation, social engineering or activity likely to impair a system unless separately agreed under explicit written authority.
Do not send passwords or secret keys by ordinary email. We will agree an appropriate secure transfer method where credentials are required.
4. Delivery, review and changes
Any delivery period starts only when payment, complete instructions, approved content, required access and other stated dependencies have been received. Unless the written scope says otherwise, dates are reasonable delivery targets rather than guarantees.
The included revision rounds are stated in the scope. A revision corrects or refines agreed work. New pages, functions, content, integrations or material changes of direction are additional work and require a written variation, price and timetable.
Delay caused by missing material, late feedback, third party platforms or a scope change extends the timetable reasonably. We may pause work if information, access or payment is overdue.
5. Acceptance and publication
We will provide the work for review where appropriate. You must review it carefully, including names, prices, claims, contact details, permissions and legal content. We publish or release the final work after your approval. Approval does not transfer responsibility to us for the accuracy or legality of material you supplied or approved.
6. Intellectual property
You retain ownership of material you supply. We retain ownership of our pre-existing methods, tools, templates, know-how, generic code and reusable components. Subject to full payment, you receive the rights in the final bespoke deliverables stated in the written scope.
Third party software, fonts, images, platforms and open source components remain subject to their own licences. We may identify the completed public project in our portfolio unless confidentiality has been agreed or you ask us not to do so before publication.
7. Confidentiality and data protection
Each party must protect confidential information received for the project and use it only for the agreed work. We process personal data as explained in our Privacy Policy. Where the project requires us to process personal data on your behalf, any necessary controller and processor terms will be agreed separately.
8. Security and third party services
Reasonable care is taken in our work, but no website, application or system can be guaranteed completely secure, uninterrupted or error free. A security snapshot is a time limited, non-intrusive review of the agreed public surface. It is not certification, a penetration test, continuous monitoring, legal advice or a guarantee of compliance or security.
We are not responsible for outages, changes, suspensions or defects in third party hosting, payment, email, domain, API, app store or other services, although we will take reasonable steps within scope to assist.
9. Cancellation and termination
Cancellation rights and refund arrangements are set out in our Cancellation and Refunds Policy. A business client may terminate only as stated in the written scope or for a material breach that is not remedied within a reasonable written notice period.
We may suspend or terminate work for non-payment, unlawful instructions, abusive conduct, a material breach, or an unacceptable security or regulatory risk. Fees remain payable for completed work and committed third party costs.
10. Quality and remedies
We will perform services with reasonable care and skill. If work does not materially conform to the agreed scope, tell us promptly with enough detail to investigate. Where appropriate, our first remedy will be to correct or reperform the affected service within a reasonable period.
Nothing in these terms excludes rights that cannot lawfully be excluded, including rights under the Consumer Rights Act 2015 where you are a consumer.
11. Liability
Nothing limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot lawfully be limited.
For a business client, we are not liable for indirect or consequential loss, loss of profit, revenue, opportunity, goodwill or anticipated saving. Subject to the previous paragraph, our aggregate liability arising from a project is limited to the fees paid for that project. These business limitations do not apply to a consumer to the extent they would be unfair or unlawful.
You remain responsible for business decisions, regulatory compliance, backups, account control and obtaining independent legal, tax or specialist advice where required.
12. Complaints
Email hello@poweredbymore.co.uk with the subject “Complaint”. Include the project, the issue and the outcome sought. We aim to acknowledge a complaint within three working days and provide a substantive response within fourteen working days.
13. General
Neither party is liable for delay caused by events beyond reasonable control. If one term is unenforceable, the remaining terms continue. A failure to enforce a right is not a waiver. No third party has a right to enforce the contract under the Contracts (Rights of Third Parties) Act 1999.
English law governs the contract. The courts of England and Wales have jurisdiction, subject to any mandatory consumer right to bring proceedings elsewhere.
